Standard information for package tour contracts:

The combination of travel services offered to you is a package tour as defined by Directive (EU) 2015/2302. (Package Travel Act: www.justiz.gv.at/pauschalreisegesetz)

You can therefore claim all EU-rights that apply to package travel. The company Wiesergut GmbH & Co.KG bears full responsibility for the proper performance of the complete package tour.

In addition, the company Wiesergut GmbH & Co.KG has taken out the legally required coverage for reimbursement of your payment and, if transport is included in the package tour, to ensure your return transport in case of insolvency.

Most important rights pursuant to Directive (EU) 2015/2302

  • Travellers shall receive all essential information about the package tour before concluding the package travel contract.
  • At least one contractor shall always be liable for the proper performance of all travel services included in the contract.
  • Travellers shall receive an emergency phone number or details for a contact point, through which they can contact the tour operator or the travel agency.
  • Travellers can transfer the package tour – within a reasonable period and, in some circumstances, subject to additional costs – to another person.
  • The price of the package tour can only be increased if specific costs (such as fuel costs) increase and if this is specifically provided for in the contract, and in any case until no later than 20 days before the start of the package tour. If the price increase exceeds 8% of the package tour price, the traveller can withdraw from the contract. If a tour operator reserves the right to a price increase, the traveller has the right to a price reduction if the relevant costs drop.
  • Travellers can withdraw from the contract without paying a withdrawal fee and receive full refund of all payments, if one of the essential components of the package tour, except for the price, are significantly changed. If the contractor responsible for the package tour cancels the package tour before the start of the package tour, travellers shall have the right to reimbursement of costs and, in some circumstances, compensation.
  • In the event of extraordinary circumstances travellers can withdraw from the contract before the start of the package tour without paying a withdrawal fee, for example if serious safety concerns exist at the destination, which can be expected to affect the package tour.
  • In addition, travellers can withdraw from the contract at any time before the start of the package tour subject to paying a reasonable and justifiable withdrawal fee.
  • If after the start of the package tour, essential components of the package tour cannot be completed as agreed, travellers shall be offered other suitable arrangements at no additional cost.
  • Travellers can withdraw from the contract without paying a withdrawal fee, if services are not rendered according to the contract and this has significant effects on performing the contractual package tour services and the tour operator has failed to take remedial action.
  • Travellers have the right to a price reduction and/or damages if the travel services are not performed or not duly performed.
  • The tour operator shall assist travellers if they are in difficulties.
  • In case of insolvency of the tour operator or – in some member states – the travel agent, payments shall be refunded. If the tour operator or, if relevant, the travel agent, becomes insolvent after the start of the package tour and transport is a component of the package tour, the return transport of the travellers shall be ensured. Wiesergut GmbH Co.KG has taken out insolvency insurance. Travellers can contact this institution or, where necessary, the competent authority, if they are being denied services due to the insolvency of Wiesergut GmbH Co.KG.
